Abstract

This research discusses cyberstalking caused by Obsessive Love Disorder (OLD) and its relevance to legal regulations in Indonesia based on criminological theory. The background of the research focuses on the legal vacuum related to handling cyberstalking rooted in psychological disorders, and the need for more specific policies in handling it. In addition, there are also cases where cyberstalking has developed into other criminal offenses such as rape, kidnapping, and murder, which reinforces the urgency of updating regulations. The method used in the research is normative juridical with analysis of laws and regulations, as well as literature review on the psychological aspects of perpetrators who experience OLD. The results show that the factors that cause cyberstalking by perpetrators with OLD include unstable psychological conditions, the need to have excessive control over someone, easy access to information technology and ineffective law enforcement against cyberstalking perpetrators. Policy recommendations include the need for more specific regulations on cyberstalking as well as the enforcement of mental health checks for perpetrators with mental disorders. The conclusion of this study emphasizes that OLD can be a mitigating factor in legal liability, provided that evidence is carried out regarding the mental health condition of the perpetrator.
