Abstract

The Ukraine v. Russia conflict, which began in 2014, has become one of the most prominent conflicts of the 21st century. In this conflict, new issues have emerged concerning the principle of Jus in Bello, particularly the involvement of a new actor, namely the Private Military Company (PMC) Wagner Group, which has been involved in violations of International Humanitarian Law. As a transnational corporate entity, the Wagner Group has an obligation to comply with international legal standards, particularly those related to human rights in armed conflict situations. However, the legal status of Wagner Group members, who are categorized as mercenaries, classifies them as unlawful combatants, complicating the enforcement of international law against them. This article analyzes the legal status of the Wagner Group as a legal subject under international law, as well as the PMC’s accountability for various violations of international law, especially international humanitarian law. Using a normative juridical research method, this article draws on various legal regulations and relevant international legal instruments to provide an in-depth insight into the legal accountability of PMCs in armed conflicts.
