Abstract

Developing countries such as Indonesia have a large number of workers, complex and dynamic. One of the things that is still highlighted today is related to the minimum wage, which is still often questioned in Indonesia. On the side of workers and laborers, expecting decent or high wages, for employers it is also burdensome because it will have an impact on the high operations or costs that the company must incur. Termination of Employment. The Job Creation Law has reaped a lot of controversy among the community, especially workers/workers in Indonesia, because it is considered that there are many significant changes that can harm workers' rights. It is important for workers to be actively regulated so that companies can maintain their competitive advantage in the current market, The findings of the study are based on the Judges' considerations in decision number 91/Pdt.Sus-Phi/2023/Pn Bdg, The Panel of Judges is of the opinion that the Plaintiff's lawsuit can be granted as an improvement as stated in the verdict. This research was carried out by normative juridical research method, namely the study of qualitative documents. In the content of decision 91/Pdt.Sus-Phi/2023/Pn Bdg, the author argues that the judge in his consideration has decided and has not provided proper and fair rights and justice to workers/laborers in the provisions of the Job Creation Law.
