Abstract

Selling at a loss, commonly known as predatory pricing, is a practice of setting low prices by large businesses to eliminate small competitors from the market. This phenomenon is becoming increasingly concerning with the rise of online trading, particularly on platforms like TikTok Shop, which has become a gathering place for Micro, Small, and Medium Enterprises (MSMEs). This research aims to analyze the impact of predatory pricing on TikTok Shop towards MSMEs from the perspectives of civil law and legal protection for affected MSMEs. The research method used is normative research with a legislative and civil law approach. Data were obtained through literature studies from various primary and secondary sources. The research findings indicate that predatory pricing on TikTok Shop can have financial losses up to bankruptcy for MSMEs. From a civil law perspective, sellers engaging in predatory pricing are considered to violate principles of contractual fairness, freedom of contract, and may be subject to administrative sanctions and compensation according to applicable laws. Legal protection for affected MSMEs involves effective law enforcement and high legal awareness among MSMEs to protect themselves from predatory pricing practices.
