Abstract

Using normative legal research with a statutory approach and a case approach, this research is prescriptive and analyzed using descriptive qualitative methods after collecting data through the literature. That Indonesia has entered the world of digital technology, including in terms of procurement of government goods and services. To reduce indications of Corruption, Collusion and Nepotism (KKN) in government, the procurement process for goods and services is carried out through electronic media. Ethics in the procurement of goods and services is good behavior from all parties involved in the procurement process. The principles that need to be applied in the procurement of goods and services include efficiency, effectiveness, transparency, openness, competition, fairness/non-discrimination, and accountability. To fulfill this principle, a maximum supervision system is needed, so that there is a need for an electronic-based audit system to make it easier for inspection officials to carry out inspections in real time. There are indications of bid rigging in the electronic procurement of government goods and services, so the government's role as a form of responsibility is needed, so the existence of the Business Competition Supervisory Commission is also one of the institutions authorized to maintain the stability of the procurement of goods and services in Indonesia. Dispute resolution through the Business Competition Supervisory Commission is carried out by parties suspected of having committed fraud in the procurement of goods and services through tenders and electronic media. The indications include similar IP addresses, similar metadata, similar offers, similar access locations and so on. The form of sanction given by the KPPU is a fine that will be imposed on the Reported Parties who are proven guilty of conspiring in the procurement of these goods and services
