Abstract
This study aims to analyze the Supreme Court's Cassation Decision No. 2113 K/Pid.Sus/2023 regarding the optimization of the application of the principles of justice and legal benefits in judges' considerations and rulings. The urgency of this research lies in the importance of the role of judges in the criminal justice system to provide a sense of justice, certainty, and legal benefits for those seeking justice. Generally, criminal cases often do not prioritize the interests of the victims and focus solely on punishing the offenders, whereas victims expect the return of unlawfully taken property. The research method used is normative juridical with an analysis of secondary data related to this issue. This study offers a new approach by emphasizing justice and benefits focused on victim recovery and offender responsibility. Unlike previous studies, which focused more on legal protection for victims and the effectiveness of ministries and law enforcement in the Indosurya Savings and Loans Cooperative case, this research examines the proactive role of judges in mediation and restitution for victims. The results of the study indicate that judges have not yet optimized the application of the principles of justice and legal benefits in both their considerations and verdicts. Thus, concrete solutions are needed to address the issues in this decision to achieve a more just and humane legal system for crime victims.
