Abstract

Sexual violence against children is a serious problem whose trend still tends to increase every year. The topography of perpetrators of sexual violence is not limited to adults and children, but in some cases of sexual violence the perpetrators experience psychosocial disorders and/or developmental disabilities. The enactment of the Law on Persons with Disabilities has been the main influence on the new definition for people who experience psychosocial disorders and developmental disabilities with the definition of Persons with Mental Disabilities. This definition is also contained in Article 38 and Article 39 of the new Criminal Code which replaces the definition of mental disability in Article 44 of the old Criminal Code. Article 38 provides new developments in criminal regulations for people with mental disabilities and/or mental disabilities using a two-track system. However, in relation to cases of sexual violence against children, the regulation needs to be further researched, this is based on the impact on children who are victims of sexual violence who are harmed both materially and immaterially. So, it is necessary to seek restitution that can compensate for the material and immaterial losses suffered by victims and can encourage recovery and prevent loss of hope for victims. This research uses systematic normative juridical research with a statutory regulation approach and a conceptual approach so that apart from being able to understand the application of criminal restitution to perpetrators with mental disabilities, it can also provide an ideal conception of the regulations related to this matter.
