Abstract

This research uses normative juridical, which means research that discusses theories of legal science and laws and regulations studied from the main legal material. This research aims to analyse how the regulation of rehabilitation and the benefits of rehabilitation for narcotics abusers in law enforcement. where the author analyses the judge's consideration in decision number 1008/Pid.Sus/2023/PN.Sby which is applied to narcotics abusers. A person suspected of abusing drugs can actually be categorised as a victim of drug abuse if we dig further. The application of rehabilitation for drug abusers is more beneficial than imprisonment. The benefits of rehabilitation for drug abusers should be used by judges as a consideration in their decisions in addition to considering the principles of justice and legal certainty. In addition, it is also necessary to carry out an assessment by the TAT for someone suspected of abusing drugs, starting from the investigation stage. Recommendations from TAT can be used as a consideration for judges in making their decisions.
