Abstract

The writing of this study aims to obtain an ideal model of chemical castration regulations for perpetrators of child sexual violence in Indonesia by comparing arrangements in Indonesia and the United States. This research was conducted using normative writing methods through a statutory approach. Through this research, it is learned that the chemical castration policy is contained in Law Number 17 of 2016 concerning the Stipulation of Government Regulations in Lieu of Law Number 1 of 2016 which is further regulated in Law 70 of 2020 concerning Procedures for Implementing Chemical Castration, installation of electronic detection devices, rehabilitation, and announcement of the identity of perpetrators of sexual violence against children. Furthermore, the chemical castration regulation is an additional sentence imposed for a maximum of two years based on Article 5 of Law Number 70 of 2020 and the implementation of chemical castration sanctions after the perpetrator has finished serving the principal crime. Rehabilitation is also needed to support the effectiveness of chemical castration in order to prevent repeat offenders
