Abstract

The State of Indonesia is a State of Law that bases everything on the existence of a form of legal regulation that governs it. The legal rules regarding land are regulated in the LoGA. Girik is initial evidence to obtain land rights in land registration where the land is customary law land, but in fact there is Girik C and SPPT PBB as the basis for land registration rights. This thesis research uses a normative juridical research method that is descriptive in nature using secondary data that examines problems related to the legal rules of the existence of Girik C and the PBB SPPT as a requirement for Land Registration in Indonesia along with criminal responsibility for the Defendants who are guilty of falsifying Girik C and the 2016 PBB SPPT. based on the case approach, namely in Decision No: 866/Pid.B/2012/Pn.Jkt.Tim Jo. Decision No.342/Pid/2013/PT.DKI Jo Decision of the Supreme Court of the Republic of Indonesia No: 522/K/Pid/ . The results of this research first, the legal rules regarding the existence of Girik C and SPPT PBB as a condition for Land Registration in Indonesia are contained in the provisions of Article 19 paragraph (2) letter c, Article 23 paragraph (2), Article 32 paragraph (2) and Article 36 paragraph (2) Basic Agrarian Law Jo. Government Regulation No. 10 of 1961 Jo. Article 3, Article 23 Government Regulation no. 24 of 1997 concerning Land Registration Jo. Article 60 paragraph (2) letter f Regulation of the Minister of State for Agrarian Affairs/Head of the National Land Agency Number 3 of 1997, along with criminal liability for Defendant I H. Asbih, Defendant II Agus Sulaiman and Defendant III Utimah were found guilty of fulfilling the elements of forgery of Girik C and SPPT PBB conducted jointly based on article 263 paragraph (1) jo. Article 55 paragraph (1) of the 1st Criminal Code. Then there is a need for integrated legal counseling with other agencies, especially regarding the implementation of land registration, so that the community understands the importance of certificates of land ownership rights and knows how the process/mechanism and the parties involved in the implementation of land registration are needed. then land registration through an intermediary or an attorney must be carried out with a strict selection process and administrative examination of the registration in order to minimize the actions of manipulating data and falsifying the basis of land ownership rights, which to this day there are still many people who have blank Girik C forms so that action can be taken forgery of Girik C.
