Abstract

Opponents of the death penalty argue that every individual has a fundamental right to life, and the death penalty violates that right. They view the death penalty as a violation of fundamental humanitarian principles and ethical values. This research uses a type of normative juridical research. The results of this research show that there are several possibilities that occur as a result of not maintaining the principles of human rights in state life. Human Rights in the UN Ulniversal Declaration (1948) Article 3 of the Declaration of Human Rights of 10 December 1948 stated "everyone has the right to livelihood, freedom and individual security". This Rulmulsan outlines the main principle in human rights, namely that no one can be deprived of the right to their life (life) arbitrarily. The suggestion from this research is that the right to life may be limited because hulkulm requires justice to restore the balance that was damaged by the violations he committed in the form of limiting his range of movement by being placed in a place of khulsuls and undergoing certain required training.
