Abstract

Behavior is a variable aspect of reality and social life also has its own behavior In Indonesia, buying and selling or transactions have become the behavior or habits of the community where when buying and selling each person finds an agreement on the goods being sold, a purchase is made based on the provisions of Article 1457 of the Civil Code. Over time, the buying and selling business began to be in great demand by conducting the widest possible trade without any protection or supervision from the government or those who have the connection to regulate the buying and selling activities. One proof that can be seen and felt is the existence of online transactions or buying and selling online or what can also be called E commerce, E commerce itself is buying and selling and marketing objects or services using electronic media. However, in buying and selling E Commerce, problems arise such as default in buying and selling. This research uses normative juridical research. To understand and explain default in electronic transactions. That the legal arrangements regarding default are contained in KUHPer 1243, Article 28 paragraph 1 of the ITE Law, Article 45 paragraph 1 of the ITE Law. There are steps or efforts to enforce the law through repressive and preventive means as well as legal channels that can be traveled through litigation or non-litigation channels.
