Abstract
Legal protection for a doctor in providing health services can be realized if a doctor can fulfil professional standards, professional service standards, standard operational procedures (SOP), and professional ethics, and also can fulfil the health needs of patients, as stated in Law number 17 2023 on health (da sein). Threats to doctors occur in several services because not many people know the procedures for administering drugs to prevent HIV transmission, while SOPs that can protect doctors only exist in 16 of the 33 HIV care, support and treatment (CST) in the South Jakarta area, and that's only for work accident cases, not yet in accordance with health regulation no. 22 of 2023 (da sollen). The aim of writing this thesis is to explain how legal protection for doctors is implemented in efforts to prevent disease and whether there are standard operational procedures that are in accordance with the Minister of Health's regulation no. 23 of 2023 regarding HIV control as a legal norm currently in force (ius contitutum) through study, review and analysis of research methods so that the application of these legal norms can be seen from the legal perspective envisioned by the State Constitution, namely law that has justice, certainty and prosperity (ius constituendum). The research method used in this writing is the normative juridical method using the statute approach and interviews. This research shows that the existence of standardized SPOs from the Ministry of Health in all PDP services is one component that can provide protection for doctors in providing health services to prevent HIV transmission.
