Abstract
Humans are born with various diverse uniqueness, and some of them have special needs or are known as people with disabilities. In this writing, focusing on an individual with intellectual disabilities, the general public often assumes that people with disabilities are less capable of doing everything, leading to them being frequently looked down upon. Consequently, the human rights of people with disabilities are often not fulfilled as they should be, especially regarding inheritance rights. This research aims to explore a comprehensive understanding of the position of a person with intellectual disabilities as an heir and the legal efforts that can be pursued. A normative legal research method is used to analyze relevant legislation and consider policies that discuss the inheritance rights of people with intellectual disabilities. Based on the research findings, it is known that an heir with intellectual disabilities cannot represent themselves and act independently in legal matters. Therefore, through a legal effort called "Pengampuan" (curatorship), their incapacity can indirectly be addressed, with the assistance of a curator. Through the curatorship process, the inheritance of a person with disabilities will not be handled arbitrarily, as it is supervised by another party acting as the overseeing curator.
