Abstract

The principle of balance is a principle adopted by the Bankruptcy Law and PKPU (Suspension of Debt Payment Obligations) Law, aimed at assessing and preventing the abuse of bankruptcy institutions and mechanisms by dishonest debtors or ill-intentioned creditors. In this study, Bank QNB Indonesia, as a creditor of PT Nipress Tbk, feels that the peace agreement originally made by creditors and PT Nipress Tbk as the debtor has not been fulfilled by the debtor, leading to a breach of contract by the debtor. Therefore, PT Nipress Tbk has filed an extraordinary effort or cassation to request the annulment of the peace agreement for PT Nipress Tbk, which has harmed its creditors and reopens bankruptcy for PT Nipress Tbk.From this issue, the principle of balance assesses that despite the peace agreement being approved or homologated by the Central Jakarta Commercial Court, PT Nipress Tbk, as the debtor who has been homologated, still intends to neglect the promises, demonstrating ill intentions towards its creditors and causing imbalance. Therefore, the cassation decision granting the appeal of the Appellant (Bank QNB Indonesia) can be considered balanced in accordance with the principle of balance.
