Abstract
In several previous studies that have been found by researchers, no one has discussed the element of defective will in sales and purchase agreements with online loans in e-commerce. The aim of this study is to identify the most common types of defects in will found in sales and purchase agreements with online loans and evaluate the specific legal impacts arising from defects in will in the context of these agreements. In addition, it contributes to understanding the legal consequences associated with defects of will in online purchase and sale agreements, providing guidelines for avoiding potentially problematic transactions. This study uses a juridical-normative method, as well as a statutory approach and a case approach which are used to explore a holistic and in-depth understanding of sales and purchase agreements through online loans in e-commerce. Thus, combining juridical-normative methods, statutory approaches and case approaches is important to provide a comprehensive review of sales and purchase agreements with online loans from a legal perspective. This study discusses the validity of sales and purchase agreements with online loans in e-commerce and the legal consequences related to defects in the will in the agreement. The research reviews the conditions for the validity of agreements based on the Civil Code. In the context of a sale and purchase transaction agreement, the validity of the agreement is recognized if the subjective and objective conditions are met. However, defects of will, such as misrepresentation and fraud, can affect the validity of the agreement, which can be void if it cannot fulfill subjective requirements. In an agreement, the existence of a defect of will is a serious potential that can result in the cancellation of the agreement itself. Consequently, the affected party has the right to take legal action, especially through cancelling the agreement by referring to defects in the will that involve elements of defects in the will.
