Abstract

The economic rights that copyright holders have enable them to exploit the results of their creative work with the aim of obtaining results in the form of economic benefits. This is the basis for the need for adequate protection for copyright holders of their creative works. Protection efforts must be provided by the government through effective preventive and repressive efforts. In reality, there are still many cases of movie piracy, especially on online sites in Indonesia. This problem results in royalties obtained by copyright holders not being obtained properly, thus requiring legal problem solving. The aim of this research is to determine and analyze the factors that cause many Indonesian films to become victims of movie piracy on online sites as well as the effectiveness of UUHC and the Joint Ministerial Decree of the Minister of Law and Human Rights and the Minister of Communication and Information in providing legal protection to copyright holders for movie piracy on online sites in Indonesia. The method used is normative juridical with a legal approach. Research shows that there are many factors that cause Indonesian movies to become victims of movie piracy on online sites, most of which come from the community. Apart from that, the legal protection provided through UUHC and the Joint Ministerial Decree of the Minister of Law and Human Rights and the Minister of Communication and Information cannot yet be said to be effective. Through UUHC, researchers are of the opinion that legal protection is provided for copyright holders of movies on the online sites is to formulate copyright infringement as an ordinary offense. Through the Joint Ministerial Regulation, researchers are of the opinion that the government also needs to be present to the public directly to build public awareness and legal compliance in the form of persuasive steps such as outreach regarding UUHC and invitations to carry out anti-piracy campaigns.
