Abstract

Restorative justice is an alternative that functions to provide space for community discussion to foster good relations and solve problems more wisely. In the implementation of restorative justice in Indonesia, it does not yet have a clear legal basis, so far legal institutions carry out restorative justice based on existing rules in their respective agencies. The police and the prosecutor's office are two legal institutions which both have their respective authorities in law enforcement and have a strong legal basis. As a policy controller and in accordance with the principle of dominus litis merit has a role to implement restorative justice, and in Law no. 2 of 2002 Polri also formulated new norms in upholding restorative justice law. This is what tried. In investigating a case, both institutions have the same authority, this is what needs to be enforced. Investigations and investigations are carried out by the two institutions and their contributions in a case settlement. This paper tries to analyze and discuss how the implementation of restorative justice for the two institutions as well as the authorities and rules of the two institutions through literature and policy studies.
