Abstract

Government Regulation Number 35 of 2021 Concerning Work Agreements for a Specific Time, Outsourcing, Working Time Break Time, Termination of Employment regulates termination of employment on grounds of urgent violation Reasons for termination of employment This is substantially the same as termination of employment on the grounds of serious misconduct in Law Number 13 of 2003 concerning Manpower which was canceled by the Constitutional Court through Decision Number 012/PUU-I/2003 because it contradicts the 1945 Constitution, especially guarantees for the right to work and work fairly and decently as part of human rights. This research is a legal research conducted using a statutory approach to answer legal issues, namely how the enforceability of termination of employment on the grounds of an urgent violation is also related to the existence of Constitutional Court Decisions Number 012/PUU-I/2003 and 91/PUU-XVIII /2020. From the research that has been done, it can be concluded that the provision regarding termination of employment for reasons of urgent violation is a form of reviving reasons for termination of employment which had previously been declared unconstitutional by the Constitutional Court and therefore has the potential to be declared contrary to the 1945 Constitution. the realization of the principle of rule of law, the rules regarding termination of employment with reasons of urgent violations really deserve to be repealed.
