Abstract

Allegations of the deportation of children in Ukraine by the Russian Government prompted the ICC to issue an arrest warrant for Russian President Vladimir Putin. After issuing the arrest warrant, a number of parties criticized it and refused to carry out the arrest warrant. This study aims to find out how Article 86 of the Rome Statute is disclosed regarding the obligations of member states in implementing the arrest warrant against President Vladimir Putin and whether the arrest warrant is in accordance with the specific provisions of the alleged crimes committed. This type of research is juridical-normative research using the Rome Statute as the main legal material and international agreements related to research. The conclusion of this study shows that Article 86 provides an obligation to ICC member states to carry out arrest warrants, although states may refuse if for reasons of national security. It is difficult to implement the arrest warrant so that it requires an amendment that regulates the implementation of arrest warrants against heads of state. Furthermore, the arrest warrant is in accordance with the provisions and the alleged violation that occurred has sufficient evidence and there is confidence that the arrest warrant is valid, but efforts are needed to give the Russian Government an opportunity to explain the situation so that the case can reach an agreement regarding the return of the children.
