Abstract
The threat of terrorism often endangers the state in the field of defence and security where there is a terrorist organization that launches extremist actions globally, namely the Islamic State of Iraq and Syria (ISIS). ISIS itself has been declared defeated by the Syrian Democratic Forces, but the defeat of ISIS raises new problems. The fate of ex–ISIS people from various other countries has become neglected, including Indonesian citizens (WNI). The Indonesian government's decision not to repatriate Indonesian Childs ex–ISIS until now. This decision is contrary to national and international law because the Indonesian Childs ex–ISIS have civil rights that must be protected by the state. The research method used is the normative juridical research method by taking a statue approach, conceptual approach, and case approach. Data collection techniques are carried out by literature study then data analysis is carried out using qualitative analysis techniques. The results show that the civil rights of Indonesian Childs ex–ISIS remain valid by placing their position as children of victims of terrorism networks as Article 59 paragraph (2) letter k of Law Number 35/2014 so that special protection can be given to restore the children's civil rights. The procedures and techniques for providing legal protection to Indonesian Childs ex–ISIS refer to Article 69B of Law Number 35/2014, Ministerial of PPPA RI Regulation Number 7/2019, and BNPT Regulation Number 6/2021, by providing education, counselling, social rehabilitation, and social assistance.
