Abstract

Corruption is a serious problem because this crime can endanger the stability and security of society, endanger socio-economic development, and also politics, and can damage democratic values and morality because gradually this act seems to become a culture. Corruption is a threat to the ideals of a just and prosperous society. The formulation of the problem in this research is why reconstruction is needed in the application of criminal acts against perpetrators of corruption during the Covid 19 pandemic and what is the ideal concept of death penalty for perpetrators of criminal acts of corruption. The research method used in this research is the normative juridical approach used in this research. For law enforcement to be effective in eradicating corruption, an integral system of law enforcement is needed, both the police, the prosecutor's office and the judiciary to jointly uphold justice under one roof, namely the judiciary. Because when a law enforcement agency is under executive power, it is easy for political intervention to enter and influence the decisions taken. Basically, if the perpetrators of corruption have fulfilled the "certain circumstances" clause in Article 2 paragraph (2) of the Corruption Law, then the death penalty can be imposed on the perpetrator.
