Abstract

Right to Immunity is currently a matter of public clarification, in terms of privileges, especially when a person enjoys immunity as provided for by law in carrying out his functions. The implementation of the release for members of the DPR-RI is still relatively weak and there are still a number of problems including the problem of setting the DPR's immunity rights in Indonesian law arrangements which are still not optimal and the regulation of the DPR's immunity rights in the Indonesian legal system in the perspective of equality before the law getting pros and cons. counter. In carrying out the functions and duties of the DPR, it was found that in the name of the privileges granted by the 1945 Constitution Article 245 as stipulated in Article 20A paragraph (3) which regulates the duties of members of the DPR are given the Right of Immunity by the Constitution and must be given strict limits. The research used is normative juridical, namely legal research conducted based on norms and rules originating from several references and laws and regulations related to the Indonesian legal system in solving problems carried out by officials of the House of Representatives. However, it must remain within the corridor of applicable statutory provisions so that abuse of power does not occur in this regard. It is therefore important to limit the ability of DPR members to carry out their representative roles. When the right of immunity is abused by officials of the People's Representative Council, the DPR officials are free from jurisdiction, but DPR officials are not completely free from jurisdiction because acts that are outside of their official duties can be tried in accordance with the jurisdiction of national lawand can be brought to justice. before the court. In Law number 2 of 2018 regarding members of the People's Legislative Assembly it has not been explicitly regulated for the duties of police investigators, the Corruption Eradication Commission (KPK), and the Attorney General's Office in conducting examinations of members of the Council. In Law number 2 of 2018 it must be written explicitly from the rights of the Police, the Corruption Eradication Commission and the Attorney General's Office.
