Abstract

Indonesia is a law-based country, thereby any human or social activity on a regular basis must be based upon the rules of law and norms applying in society. Law cannot be separated from human life since it governs human behavior. Since the Covid-19 pandemic has struck the world including Indonesia, the government has issued several policies including the implementation of social distancing, physical distancing and Pembatasan Social Berskala Besar (PSBB) or LargeScale Social Restrictions; and issued rules for health protocols and sanctions for violators. The PSBB policy is as referred in Article 93 of Law no. 6 of 2018 concerning Health Quarantine since PSBB is a form of health quarantine. The criminal sanctions are applied to cause a deterrent effect to PSBB policy violators. The imposition of criminal sanctions on violators of the PSBB policy is deemed inaccurate since it is based on the criminal sanction itself whose one principle in Indonesian criminal law that regulates rules of criminal law which is ultimum remedium. This means that if a case can be resolved by other means, then criminal law should be used as a last resort in law enforcement
