Abstract

In this study, we will discuss the implementation of land grants for the construction of drinking water facilities that are made under the hands and how the validity of the underhand grant agreement that occurs in the implementation of underhanded grants in the PAMSIMAS program. in the field in the PAMSIMAS program, as well as knowing how the legal validity of land grants carried out under the hands. The writing of this thesis was made using empirical juridical research methods. With the Pamsimas program held by the government which aims to provide clean water facilities for the community, land is needed to support construction development, so that the community must contribute in the form of donating their land to local governments as a condition that must be met for the implementation of the PAMSIMAS program. This research was conducted in 3 provinces, namely Riau Province, Bangka Belitung Province, and Jambi Province. The definition of a grant as explained in the provisions of Article 1666 of the Civil Code is an agreement whereby the donor in his lifetime surrenders an object from his ownership voluntarily without any coercion or compensation, and irrevocably in the future. Based on the results of the research, problems can be obtained. in this study is the implementation of grants by village communities in the Pamsimas program by making a grant statement under the hand which means it is done without a PPAT deed and the land grants given on average do not have a land certificate or have not been registered with the registrar of the National Land Agency, and how valid it is. This happened due to a lack of legal understanding of the procedure for land grants in accordance with the legislation and it has become a habit for village communities to carry out land grants under their hands without being carried out before the PPAT, another reason is the lack of costs for making the PPAT deed. The solution to this problem is to provide socialization to the community to understand what a grant is and register the land one year before the construction is carried out. In addition, the validity of the grant letter implemented is invalid because Government Regulation No. 24 of 1997 concerning land registration contains that each grantor of land and building grants must be carried out with a Land Deed Official Deed (PPAT). If the grant in the form of land is not made by a notary, it will not have legal force.
