Abstract

During COVID-19 pandemic, there was an increase in the number of forced marriages in Indonesia which reached 300%. In its Annual Records, Komnas Perempuan found 23,126 cases of child marriage in 2019 and increased to 64,211 cases during 2020. The purpose of this study was to determine the factors that influence the occurrence of forced marriages in children during the COVID-19 pandemic and legal protection for children who are victims of forced marriages by parents during the COVID-19 pandemic. The research was conducted using a normative juridical method which can produce primary data, namely legal materials consisting of laws and regulations including Law no. 1 of 1974 concerning Marriage, Law. 23 of 2002 concerning Child Protection, Law no. 23 of 2004 concerning the Elimination of Domestic Violence, and Law Number 16 of 2019 Amendments to Law Number 1 of 1974 concerning Marriage, which eventually become secondary data for this research. The results of the study indicate that the factors that influence child marriage have systemic factors or come from the environment, family or individual and legal protection for children victims of forced marriages can be categorized as having deficiencies because in fact marriages still occur a lot in Indonesia.
