Abstract
Indonesia is a country with abundant natural wealth but there is poverty and corruption occurs, this is not in line with the spirit of the nation that Indonesia is a welfare state and also a state of law. The poverty rate of the Indonesian population cannot be significantly reduced in a 65-year grace period. This is further exacerbated by data released by the KPK that during the Covid-19 pandemic there were a number of Ministers of the Advanced Indonesian Cabinet whose wealth actually increased. Eradication of corruption needs to be carried out in an extraordinary way, meaning that corruption is an extraordinary crime. The maximum penalty for corruptors according to Law No. 20 of 2001 is the death penalty. However, during the 22 years that the law was passed, the number of corruption cases was not reduced but increased, which means that the death penalty is not scary for corruptors. The motivation of the perpetrators of corruption is to want to be rich by going against the law, therefore the deterrent effect is not a death penalty but an absolute impoverishment penalty.
