Abstract
Violence against suspects in the investigation process still occurs a lot today, not a few suspects are tortured by police investigators to reveal that it is the suspect who committed the crime. Based on article 52 of the Criminal Procedure Code, it is stated that during the investigation process the suspect has the right to give information freely to police investigators. In this final project, the author uses a normative juridical research method with a statutory approach. By using normative juridical research, it can be concluded: 1. What causes police investigators to commit acts of violence in the investigation process is due to the very short examination time, lack of or at least budget and inadequate facilities to find evidence belonging to the suspect. suspect, so that the police prefer to focus on the confession of the suspect. 2. The protection of the suspect itself can be seen from article 54 of the Criminal Procedure Code which contains the rights of the suspect or defendant. Even though Indonesia has ratified the Convention Against Torture in 1998, with the ratification of the regulation, it is hoped that the Indonesian government can prevent the practice of torture in various forms.
