Abstract
Marriage is important for human life, especially for the creation of regeneration of life. Not only for adults, marriage also often occurs for minors. This of course occurs due to many factors such as economics, education, socio-culture, customs, and the most common is pregnancy out of wedlock. Marriage as a legal event is contained in Law Number 1 of 1974 as amended to Law Number 16 of 2019 concerning Marriage (hereinafter referred to as the Marriage Law). A person basically cannot get married if his age has not reached the limit determined by law. However, this provision can be excluded by the existence of a marriage dispensation. Following the updating of the marriage regulations, there has been a critical increase in the number of applications for marital dispensation. This is due to the expansion of marriage as far as possible for women to 19 years. This guideline change was made to address the crisis of child marriage in Indonesia. Tragically, the increase in the number of applications for dispensation was not followed by strict standards, so most were granted by judges. The purpose of this study is to provide a study whether the granting of a marriage dispensation is in accordance with the purpose of marriage in the Marriage Law, and how the concept of granting a marriage dispensation should be in accordance with the provisions of the law.
