Abstract

This research was conducted to determine what forms of children protection programs as well as what needed to be considered by the judges as the law enforcement for children who committed molestation in determining the criminal sanctions. Children as the perpetrator of molestation should receive appropriate punishment in accordance with applicable law. The termination of criminal sanction with children as the perpetrator of molestation is not exactly as simple, considering the children rights of growth and development. In terms of safeguarding and protecting of the rights of children with legal problems, Law no. 35 of 2014 regarding Child Protection (UUPA) as well as Law no. 11 of 2012 regarding Juvenile Criminal Justice System (UU SPPA) were made. In this study, the researcher method of researching was empirical juridical by applying the applicable rules, as well as possessing a relation with the matter that took place in this study. The normative juridical approach aimed to examine the problem by merging the primary as well as the secondary datas sourced from legal materials. Keywords: Restorative Justice, Molestation, Child.
