Abstract
This study aims to contribute ideas and applications to the legal world of parties who will later be involved in cases of child offenders, the characteristics of providing rehabilitation to children with narcotics abuse, and analyze the judge's considerations in providing rehabilitation to children with narcotics abuse. This research uses a normative research method using a statutory approach, a case approach, especially Decision No: 02/Pid..Sus.Anak./2018/PN PKL Research results in Judge Sentenced Confinement for 1 year and 3 months of Job Training and the child was not rehabilitated properly and if there was rehabilitation it would have a good impact on the child not to repeat his actions, the problem of narcotics abuse has become the concern of various groups, especially the involvement of children as narcotics couriers which is a series of conspiracy in carrying out the illegal distribution of narcotics. In the capacity of a child being used as a courier, it is a matter of great concern where the child will face the law and is classified as having committed a narcotic crime. The formulation of the problem in this paper is how to use rehabilitation as an alternative to punishment for children as victims of narcotics abuse and how to rehabilitate mechanisms for children as victims of narcotics abuse. Narcotics Abuse. The type of research in writing this thesis is normative legal research by using primary legal sources, namely laws and regulations on Narcotics, Child Protection, and the Juvenile Criminal Justice System as well as secondary legal materials, namely books and legal journals. This paper concludes that rehabilitation is very much needed for the punishment of children in the case of children as narcotics couriers because of the rules of Restorative Justice for Children.
