Abstract
This study aims to determine the Responsibilities of Shopee as an Electronic System Operator in the sale of counterfeit cosmetics and the weakness of its surveillance system in terms of related laws and to make the theory of legal responsibility as the knife to examine this research. In this research, case study that given is about fake cosmetics at Shopee as well as interviews with seller and consumer who have used the electronic system activities through Shopee as an Electronic System Operator. The method used in this research is normative research. The results of this study are that Shopee as the Electronic System Operator is also responsible for the sale of counterfeit cosmetics in its electronic system, because the Electronic System Operator according to the Law is also a business actor because it also benefits in economic activities through this electronic transaction, and Shopee as the Operator The Electronic System provides a place for sellers to carry out buying and selling activities. The many occurrences of fake cosmetic sales to Shopee as an Electronic System Operator proves the weakness of Shopee's surveillance system for electronic system activities. Shopee as the Electronic System Operator has a large role in surveillance so that it should be able to detect false and suspicious electronic information, also have the freedom to close accounts, and Shopee as the Electronic System Operator must increase its surveillance as a form of preventive effort in preventing the spread of sales of fake cosmetics on marketplace.
