Abstract
This scientific article analyzes and discusses the Juridical Analysis of the Bandung District Court Decision Number: 57/Pid.Sus.Tpk/Pn.Bdg (Criminal Case for Special Crimes). In this paper, it contains 3 Problem Formulations, namely: first, Can the indictment be changed in case Number 57/Pid.Sus.Tpk/2021/PN.bdg dengan terdakwa M. M. TOTOH GUNAWAN GUNAWANby the public prosecutor when the file is in the Bandung Special District Court? Second, can article 55 paragraph 1 to 1 of the Criminal Code be imposed in the Court's Decision on Case Number 57/Pid.Sus.Tpk/2021/PN.bdg dengan terdakwa M. M. TOTOH GUNAWAN GUNAWANand related to Case 55/Pid.Sus.Tpk/2021/PN.bdg? Third, is the decision on the Corruption case 57/Pid.Sus.Tpk/2021/PN.bdg dengan terdakwa M. M. TOTOH GUNAWAN GUNAWANin the midst of the COVID-19 pandemic a death penalty and can the judge impose a sentence that is more than the charges and demands? The analysis uses the basic basis of legislation, expert opinions and can be concluded. First, it can be concluded that the Amendment to M. M. TOTOH GUNAWAN Gunawan's Indictment which has been submitted to the Bandung District Court can still be changed as long as the Panel of Judges has not set a trial day or no later than 7 days before the first trial begins. Second, if it is subject to article 55, it should be more appropriate to be subject to article 15 of the Law on the Eradication of Criminal Acts of Corruption. Third, the death penalty can be applied as long as it fulfills the conditions and can be used by Ultra Petita Judges's authority.
