Abstract

This study aims to analyze the practice of marriage agreements and the protection of women’s rights during marriage after the Constitutional Court decision Number 69/PUU-XIII/2015. This study uses a normative juridical research with a statutory approach and a case approach and conducts interviews with the perpetrators of marriage agreement makers. In addition, this study analyzes the practice of the separation of assets on the marriage agreement practiced at the Tigaraksa Religious Court Number: 049/Pdt.P/2020/PA.Tgrs. This study shows that a marriage agreement can protect women’s rights, especially in the ownership of assets in marriage, to prevent arbitrary acts on the part of the husband due to the mixing of assets. In practice, the separation of assets in marriage is accommodated by religious court judges as a preventive form of protecting the rights of women, especially Indonesian citizens in mixed marriages in the event of a divorce. The Constitutional Court’s decision in Decision Number 69/PUU-XIII/2015 and the decision of the religious court have been in line in responding to the permissibility of making a marriage agreement related to the separation of assets after marriage.
