Abstract

The purpose of this research is to analyze legal protection for debtors for the auction of mortgage execution that does not reach the maximum value and to identify how the government should determine the execution auction process and the limits in conducting the auction for execution of mortgage rights. This type of research uses normative juridical research methods. Article 6 paragraph (2) Decree of the Minister of Finance jo. Article 6 paragraph (2) The decision of the Directorate General of Accounts Receivable and State Auction gives the seller the right to determine auction conditions which are specific in nature and do not contradict the general auction regulations or existing laws and regulations. The auction for the execution of mortgage rights must be carried out at the KPKNL, namely the government which has a position based on the provisions of the applicable laws so that the auction for execution is carried out in accordance with the applicable regulations
