Abstract
The widespread spread of firearms among civilians is a global phenomenon. The unorganized supervision of the possession of firearms, both legal and illegal, owned by the general public, police and the Indonesian National Armed Forces, is one of the causes of crimes involving the misuse of firearms in Indonesia. The problems in this research are 1) How is the regulation of firearms ownership by civil society and criminal responsibility in Indonesia? 2) How to achieve optimal law enforcement for perpetrators of misuse of firearms in providing protection for the community? By using a research method with a juridical normative approach and an empirical juridical approach, it is found that 1) The current firearms ownership regulation that regulates enforcement of the misuse of firearms has not been able to provide a sense of security for the community. 2) To achieve optimal law enforcement for perpetrators of firearms misuse, the establishment of a special agency for handling the illegal firearms trade and by tightening the Indonesian border area. Suggestions in this study are 1) Law enforcement against perpetrators of illegal firearms abuse should be carried out by prioritizing human rights by carrying out legal processes in a professional, transparent and proportional manner. 2) It is necessary to have only 1 (one) law, which regulates the offense of firearms so that the terms used are not different.
