Abstract

This research is the result of the author's study from the point of view of a prosecutor / public prosecutor, which aims to determine the extent to which the Notary / PPAT can be held accountable for the issuance of the Sale and Purchase Deed (AJB) and the spiltzing of the HGB Certificate (Parent) regarding irregularities in the provision of KPR facilities. as the Decision of the Bandung Corruption Court No: 109 / Pid.Sus-TPK / 2018 / PN.Bdg dated April 10, 2019, which in his consideration stated that the witness as a Notary / PPAT in the process of handling documents related to the provision of KPR facilities is contrary to the Housing Ministerial Decree. People Number: 09 / KPTS / M / 1995 and PP Number 37 Year 1998. To provide an understanding of the norm problems applied in a legal case through a case approach, the authors use the normative legal research method. Inclusion offense in article 55 (1) -1 of the Criminal Code as an extension of responsibility, especially participating in the implementation, namely medepleger can be applied to Notary / PPAT if the elements of error are fulfilled and in the context of implementing the inclusion offense, case development can be carried out through a pattern of handling special crimes. This requires a comprehensive and objective understanding and coordination with investigators of the Sukabumi City Police with the aim of sharing information and avoiding duplication of cases and anticipating nontechnical matters.
