Abstract
Fulfilling the rights of victims of human rights violations are the state responsibility. However, in practice victims of gross human rights violations cannot enjoy their rights due to various obstacles. This study aims to describe an alternative mechanism for fulfilling the rights of victims of gross human rights violations and the obstacles faced in implementating. This research uses empirical normative method. Based on the discussion, it is known that the rights of victims of gross human rights violations have been regulated in several laws, namely: Law Number 26 of 2000 concerning Human Rights Courts, Law Number 13 of 2006 concerning Protection of Witnesses and Victims which have been amended by Law Number 31 of 2014, Government Regulation Number 2 of 2002 concerning Procedures for Protection of Victims and Witnesses in Serious Human Rights Violations, and Government Regulation Number 7 of 2018 concerning Providing Compensation, Restitution and Assistance to Witnesses and Victims. The study concluded that the protection of victims of gross human rights violations includes the provision of compensation, restitution and assistance (medical, rehabilitation, psychological, and psychosocial), and material compensation. In its implementation, obstacles were found due to the provision that to obtain the status of a victim of serious human rights violations one must wait for a court decision, application for protection itself takes a long time and is a difficult process, and has not yet become the government's priority agenda.
